Penrith Development Control Plan 2014

Development Control Plans (DCPs) are documents that supplement the provisions of Local Environmental Plans (LEPs) with more detailed planning and design guidelines.

The Penrith Development Control Plan 2014 (Penrith DCP 2014) has been prepared to support all planning instruments applying to the Penrith Local Government Area (LGA), including the Penrith LEP 2010. It represents a consolidation of all previous DCPs which applied to the City so that a single, City-wide DCP applies to the LGA. 

The Penrith DCP 2014 was adopted by Council on 23 March 2015 and came into effect on 17 April 2015.

Penrith DCP 2014 is Council’s current plan that facilitates development permitted under LEP 2010. DCP 2014 sets out Councils objectives and development controls on what built form and environmental outcomes are acceptable for different land uses and development types. Applicants must demonstrate compliance with these controls when they propose new developments.

A full review of DCP 2014 is currently underway to respond to the large amount of strategy work being undertaken through our Local Strategic Planning Statement and our program for an Local Environmental Review. Other factors that have influenced the need for a DCP review include strategic planning, need for more contemporary controls to reflect community needs, recent legislation and standardisation changes. The DCP Review will establish a contemporary set of development controls that will guide future built form outcomes for Penrith City. The review will be an extensive project that considers every element and control of DCP 2014, representing a wholesale review and restructure of the plan. The DCP program will be undertaken in three (3) 3 stages:

  1. Housekeeping amendment
  2. Comprehensive review
  3. At the completion of Councils strategy program.

These stages are intended to align with the LEP Review.

Note – NSW Government Zone Reforms

The NSW Government completed two reforms to rename ‘Environment Zones’ and ‘Business and Industrial Zones’ under s2.1 Land use zones within the Standard Instrument (Local Environmental Plans) Order 2006. The change occurred across all standardised local environmental plans that are in place across New South Wales.

A reference to ‘Environment Zones’ or ‘Business and Industrial Zones’ in a document should be taken as:

Environment Protection zone

Mamre West Precinct DCP 2016

The Mamre West Land Investigation Area DCP applies to land known as the Mamre West Precinct. The Mamre West Precinct includes the following land:

  • 573-577 Mamre Road, Orchard Hills (Part Lot 1, DP 1117416)
  • 579-583 Mamre Road, Orchard Hills (Part Lot 2172, DP 1153854)
  • 585-649 Mamre Road, Orchard Hills (Part Lot 2171, DP 1153854)

This DCP was made by the Secretary of the NSW Department of Planning and Environment and came into effect on 9 August 2016. As a result, Penrith DCP 2014 no longer applies to this land.

Mamre Road Precinct DCP 2021

The Mamre Road Precinct Development Control Plan 2021 (DCP) applies to land within the Mamre Road Precinct as identified by State Environmental Planning Policy (Western Sydney Employment Area) 2009. This area is shown on the Land Application Map (Figure 1) of the DCP.

This DCP was adopted by the Group Deputy Secretary, Planning Delivery and Local Government (under delegation from the Secretary) of the Department of Planning, Industry and Environment (DPIE) on 17 November 2021 and came into force on 19 November 2021. As a result, Penrith DCP 2014 no longer applies to this land.

The DCP provides planning controls for future industrial development in the Mamre Road Precinct including building design controls, a road network, drainage strategy and landscaping and biodiversity controls.
